Product Purchase and Return Policy

  1. This Product Purchase and Return Policy is part of our Terms of Service, and any capitalized terms used but not defined in this Product Purchase and Return Policy will have the same meaning as in our Terms of Service. If you would like to purchase any merchandise or products offered by TreVita on any of the TreVita Services (collectively, “Products”), your purchase will be governed by the terms of this Product Purchase and Return Policy. You acknowledge that all Products purchased under this Product Purchase and Return Policy on the Sites are intended for personal non-commercial use only and will not be re-sold or exported.
  2. JURISDICTION; DISPUTE RESOLUTION & WAIVER OF CLASS, CONSOLIDATED AND REPRESENTATIVE ACTIONS. IT IS IMPORTANT THAT YOU READ THIS SECTION OF THE AGREEEMENT CAREFULLY.
    1. All parties agree to the Terms in the TreVita Terms of Service, specifically Section 21 and Section 22.
  3. PAYMENT METHODS AND BILLING
    1. If you wish to purchase Products on any of the TreVita Services, payment may be made by credit card, debit card or any other such method as TreVita may introduce on the Service in our exclusive discretion. TreVita reserves the right to accept or refuse any payment made in any form. To purchase Products on the Service, you must provide valid credit or debit card information on the Service’s order form. This information includes, but is not limited to, your credit card number, the expiration date of your credit card, the CVV information, your billing address and the name as it appears on the card. TreVita is subject to change the credit and debit cards TreVita accepts in our exclusive discretion. By submitting such credit or debit card information, you give TreVita permission to charge your purchases to the card that you designate on the order form. You represent and warrant that you have the legal right to use any credit card(s) or other payment method(s) submitted on the Services in connection with any purchase of Products, that the charges incurred by you on the Services will be honored by your credit or debit card company, you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted on the Services at the time of your order, and that the information you supply to us is true, correct and complete. TreVita reserves the right to cancel any order, any time and for any reason. If your credit or debit card has already been charged and your order is cancelled, you shall receive a credit to your card account in the amount of the charge. TreVita will not be responsible (i) for any charges that your card issuer may apply to you as a result of our processing your order, (ii) if your card issuer refuses or fails to authorize payment by you, or (iii) for any delays or non¬delivery of Products that may arise due to any validation checks that may be carried out regarding your payment or identification. If you select the option to buy online and pick up at one of our stores, bag fees may be applied to your order upon pickup. Please bring a valid method of payment. TreVita may employ the use of third party services for the purpose of facilitating payment and the completion of purchases of Product on the Services. By submitting the aforementioned information, you grant us the right to provide the information to these third parties, subject to the terms of our Privacy Policy. We reserve the right to refuse or cancel your order of Products if fraud or an unauthorized or illegal transaction is suspected.
  4. ORDER ACCEPTANCE
    1. Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Your credit card or other approved method of payment will not be charged until your payment method is authorized, the order information is verified for accuracy and your order is shipped.
    2. Some situations that may result in your order being cancelled include:
      1. Limitations on quantities available for purchase,
      2. Inaccuracies or errors in Product or pricing information,
      3. Product or ingredient restrictions mandated by local, state, national or international regulations, or
      4. Problems identified by our credit and fraud avoidance group.
    3. TreVita may also require additional verifications or information before accepting any order. TreVita will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after your credit or debit card has been charged, we will issue a credit to your card in the amount of the charge.
  5. ORDER RETURNS
    1. Making a Return
      1. Customers may return any opened or unopened Products purchased from any Services to TreVita within 30 days. If return unopened the customer will receive the return in the original form of payment. If opened, the customer will receive a TreVita merchandise credit.
      2. Customers must return Products via mail, must carefully package the Product, and are responsible for the cost of return shipping.
      3. Customer must contact TreVita customer service at support@trevita.com for the address to ship returns to.
    2. Damaged or Defective Items
      1. TreVita makes every effort to package your order so that it will arrive in great condition. Unfortunately, sometimes items may be damaged during shipment. We understand your frustration and we will do everything we can to replace the product as quickly as possible. If you have received a damaged item, please e-mail us at support@trevita.com. Give us your name, order number and the item number that was damaged and we will arrange for the damaged item to be replaced immediately.
  6. SHIPPING AND HANDLING; INTERNATIONAL ORDERS
    1. International shipment rates vary based on total package weight and final destination. Pricing on the Services do not include duties, insurance costs, tariffs, or value-added taxes (VAT), sales taxes or similar taxes. Free shipping promotions do not apply to international orders.
    2. If you place an order for shipment to an international address, you will be responsible for paying any VAT and other taxes, tariffs, import or export duties, and other similar taxes, duties or fees attributable to such orders. These taxes, duties and fees, if assessed, are the sole responsibility of the package recipient, who will be billed for them by the local Customs office. We suggest you check with your local Customs office for any documents you may need before placing your order.
    3. With respect to shipments of Products to consumers, wherever they may reside, title to Products will be shipped FOB TreVita’s plant and all risk of loss shall pass to you immediately upon our delivery of the Products to the common carrier. You are solely responsible for providing TreVita with accurate shipping information and a valid phone number or email address. In the event that any Product is returned to TreVita as a result of your failure to provide TreVita with accurate shipping information, you shall be responsible for any additional shipping fees or other charges that may be applied to the return of the Product to us or in re-sending the Product to you.
    4. Please note that refunds will not be issued for any order that is refused or abandoned by the intended recipient, orders that can’t be delivered due to an address error, or orders seized by Customs.
    5. TreVita will arrange for shipment of the Products to you. You will pay all shipping and handling charges specified during the ordering process. Shipping and handling charges are reimbursement for the costs we incur in the processing, handling, packaging, shipping and delivery of your Products.
    6. Shipping and delivery dates are estimates only and cannot be guaranteed. TreVita is not liable for any delays in shipments.
  7. PRICING OR TYPOGRAPHICAL ERRORS
    1. We work hard to provide accurate Product and pricing information. However, pricing or typographical errors may occur. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or Product information, TreVita shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item. If an item is incorrectly priced, TreVita will either contact you for instructions or cancel your order and notify you of such cancellation. Prices and availability are subject to change without notice.
  8. QUANTITY LIMITS AND ITEMS FOR RESALE
    1. TreVita reserves the right to limit the quantity of items purchased per person, per household or per order. These restrictions may be applicable to orders placed by the same account, the same credit card, and also to orders that use the same billing and/or shipping address. We will provide notification to the customer e-mail and/or billing address provided should such limits be applied. TreVita also reserves the right to prohibit sales to dealers.
  9. ADDITIONAL TERMS
    1. Additional terms relating to certain Products (such as prices, methods of payment, our policies with respect to returns, refunds, and cancellations and/or exchanges) will be posted on any of the Services on the pages describing the Products.
